Our services are provided for lawful purposes only. You may use the website and ShiftAware in accordance with these Terms and any applicable app store rules. We may update, modify, or discontinue features or services with reasonable notice where practicable.

• You must be legally able to enter into a binding agreement in your jurisdiction.
• You are responsible for ensuring your device and account access remain secure.
• You must not misuse our services, attempt to disrupt them, or access them through automated means except as expressly permitted.

ShiftAware and related content are for general fatigue awareness and informational purposes only. They are not medical devices and do not provide medical advice, diagnosis, or treatment.

• Always seek the advice of a qualified health professional regarding any medical condition or concern.
• Do not disregard professional medical advice or delay seeking it because of something you read or see in our services.
• In an emergency, contact your local emergency services immediately.

User Responsibilities

You agree that you will:

• Provide accurate information where you choose to share it with us.
• Use our services only in compliance with applicable laws and regulations.
• Not use our services in any way that could harm others, infringe rights, or interfere with the operation of our systems.

Limitation of Liability

To the fullest extent permitted by applicable law, Aware Labs and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use our services.

Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the amount you paid us for the services giving rise to the claim in the twelve (12) months before the claim, or, if greater, one hundred Australian dollars (AUD $100), except where liability cannot be limited by law.

Some jurisdictions do not allow certain limitations; in those cases, our liability will be limited to the maximum extent permitted by law.

• App distribution through Apple App Store or Google Play is subject to the relevant store terms.
• Your use of linked sites or services is at your own risk.

We may suspend or terminate your access to our services if you breach these Terms or if we are required to do so by law. You may stop using our services at any time by uninstalling the app or ceasing use of the website.

Changes to Terms
